Andrej Babiš, the self-styled tycoon who secured victory in the recent parliamentary vote, has declined to offload his extensive corporate assets, while asserting he will address a ethical dilemma that might block him from assuming the role of head of government.

Position on Business Holdings

Babiš, whose political movement came first in the autumn election but lacked a majority in parliament, declared in a social media post that he would not divest his Agrofert conglomerate, which is active in farming, food processing, and chemicals.

“I have consistently said I will never sell Agrofert. I have repeatedly said I will address the conflict of interest in accordance with national and European laws,” the billionaire commented. “This is different from selling a pastry in a bakery.”

President's Demand

The Czech president, Petr Pavel, announced that the elderly political figure must clarify openly how he will remove ethical conflicts stemming from his business activities before being appointed premier.

The Czech constitution “clearly mandates the head of state to consider the possible emergence of a ethical issue and the ways to address it” when appointing cabinet members, Pavel's office noted.

The head of state “expects clarity in what specific way Andrej Babiš will fulfil his constitutional and legal obligations”, the announcement added, stating that Pavel was prepared to designate Babiš as prime minister “immediately” once the issue was resolved.

Business Operations and Regulatory Concerns

Babiš's several hundred firms, primarily under the Agrofert umbrella, function in the nation and other regional states, receiving substantial funds in national and EU farming and other grants, as well as government deals.

Under national legislation, government ministers are barred from obtaining state support or agreements. The anti-corruption organization Transparency International has indicated that to prevent a conflict of interest, Babiš must either divest, refuse public contracts, or not enter public office.

Previous Tenure and Present Plans

Babiš said he would “abide by the regulations” if appointed as prime minister, but declined to detail how in beforehand because the issue was “an extremely sensitive and private affair for me, and journalists will always question me anyway”.

During his initial tenure as prime minister, from 2017 to 2021, Babiš faced multiple legal battles and an European inquiry over potential ethical issues. He placed his holdings into fiduciary arrangements, while retaining some influence over them.

A judicial body and the European Commission both determined that this was insufficient. Babiš confirmed recently that he was once more the exclusive proprietor of Agrofert and insisted he was “implementing measures” to avoid a conflict of interest, but refused to reveal details.

Governing Deal and Foreign Policy Implications

The wealthy politician has concluded a governing pact with two rightwing fringe parties, the far-right, pro-Russian SPD, which has called for a referendum on leaving the EU, and the Motorists for Themselves, which has mainly campaigned against the EU’s environmental policy.

The incoming administration, if confirmed, is expected to strengthen the populist bloc in central and eastern Europe and could strain backing from Western nations for Ukraine – although Babiš has contacted Ukraine’s president, Volodymyr Zelenskyy, to confirm of Czech support.

Pavel, who as president shares responsibility for foreign policy, also demanded that the government agenda include a declaration on the official stance on the conflict in Ukraine, with a pledge to fulfilling alliance duties.

The president has earlier said he would not endorse any cabinet candidates who might doubt the nation's EU and Nato commitments, a requirement that the ultra-conservative party has said it will meet by proposing non-partisan experts.
